Terms & Conditions
About These Terms
These Terms & Conditions (“Terms”) govern your use of CraftersWhoCare.org and all services provided by Crafters Who Care (“CWC,” “we,” “us”), a 501(c)(3) nonprofit organization incorporated in Texas. EIN: 41-5087041.
By using our website, purchasing from us, donating artwork, registering for a class, or otherwise engaging with our services, you agree to these Terms. If you do not agree, please do not use our website or services.
These Terms work alongside our Return & Refund Policy and our Privacy Policy, both of which are incorporated here by reference.
Use of This Website
You agree to use this website only for lawful purposes. You may not use this site to transmit harmful, offensive, or misleading content, or to interfere with the operation of our website or services.
We reserve the right to refuse service, decline or cancel any order, decline any artist submission, or restrict access to our website at our discretion, including where we believe these Terms have been violated.
Minors
Our website is intended for use by individuals 18 years of age or older.
We do not knowingly collect personal information from, or accept submissions from, children under 13 years of age. Artist donations from minors are accepted only from artists between the ages of 13 and 17. Artists aged 13 to 17 may donate work only through a parent or legal guardian. The parent or legal guardian must provide their own contact information and must review and sign the Youth Artist Donation Agreement on the minor’s behalf. A minor’s signature alone does not create a binding agreement.
Public recognition of a minor artist requires the explicit written consent of the parent or legal guardian, and the information we publish about a minor artist is limited as described in our Privacy Policy.
If you are under 18, please ask a parent or legal guardian to complete any submission, purchase, or registration on your behalf.
For purposes of these Terms, “minor” means any individual who has not yet reached eighteen (18) years of age, regardless of any variation in the age of majority under the laws of any other jurisdiction.
Artist Donation Program
By submitting an Artist Donation Application you agree that:
-
Submission does not guarantee acceptance
-
Accepted donations are irrevocable once the Artist Donation Agreement is signed
-
No monetary compensation, commission, royalty, or proceeds will be provided to donating artists
-
All donated items must be original works, handmade by you, safe for resale, and free of third-party intellectual property rights unless written licensing documentation is provided
-
CWC retains sole discretion over pricing, promotion, bundling, and disposition of all donated items
-
Proceeds from sales support charitable causes selected by the CWC Board of Directors
-
Artists must be at least 13 years of age; artists aged 13 to 17 must have a parent or legal guardian complete and sign the Youth Artist Donation Agreement
The applicable Artist Donation Agreement governs the full terms of any accepted donation.
Intellectual Property Policy
CWC does not accept items depicting copyrighted characters, licensed intellectual property, trademarked logos, or identifiable celebrity likenesses without written proof of licensing. This includes but is not limited to Disney, Marvel, DC, and other branded fictional characters. Submissions containing unlicensed IP will be declined. Artists indemnify CWC against any claims arising from IP violations in donated items.
All website content, including text, graphics, logos, photographs, and digital designs, is the property of Crafters Who Care and may not be reproduced without written permission.
Purchases & Payments
All sales are final except as outlined in our Return & Refund Policy. Sales tax of 8.25% is collected on applicable Texas transactions and remitted to the State Comptroller. Payment processing is handled securely by Wix Payments.
We make every effort to display products accurately, but handmade items vary and screen colors differ between devices. Minor variation is expected and is part of the nature of handmade work.
Returns & Refunds
Returns, refunds, cancellations, and refund processing timelines are governed by our Return & Refund Policy, which covers handmade items, printed publications, digital downloads, and educational programs. Please see our Return & Refund Policy for complete terms.
Digital Products
Digital downloads, including digital coloring books and printable files, are non-refundable once downloaded or accessed. Digital products are licensed for personal, non-commercial use only and may not be resold, redistributed, or reproduced for commercial purposes.
Proceeds from digital product sales support CWC operations and programs and are not allocated to a specific partner charity campaign.
Classes, Workshops & Private Coaching
CWC offers educational programming including virtual classes, workshops, private coaching sessions, and related instruction (collectively, “Educational Programs”).
Private coaching sessions are non-refundable. Rescheduling may be arranged in advance and is subject to availability. Cancellation terms for group classes and workshops are set out in our Return & Refund Policy.
Class registration fees do not include craft supplies unless specifically stated. You are responsible for obtaining your own supplies and for the safe use of any tools, cutting machines, adhesives, or materials used during a session.
Educational Programs are provided for instructional purposes only. Revenue from Educational Programs supports CWC operations and programs and is not allocated to a specific partner charity campaign.
Partner Nonprofit Program
Organizations participating in CWC fundraising campaigns agree to the terms of the CWC Partner Nonprofit Campaign Agreement.
CWC makes no guarantee of sales volume or fundraising revenue. Net proceeds are distributed within sixty (60) to ninety (90) days of campaign conclusion, subject to post-campaign reconciliation.
Disclaimer of Warranties
All items are sold as-is. To the fullest extent permitted by law, CWC disclaims all warranties, express or implied, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Handmade items are individually made and will vary in size, color, texture, and finish. Such variation is not a defect.
Our website and services are provided on an “as available” basis. We do not warrant that the website will be uninterrupted, error-free, or free of harmful components.
Limitation of Liability
To the fullest extent permitted by law, CWC shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of this website or our services. CWC’s total liability shall not exceed the amount you paid for the specific item or service giving rise to the claim.
Order of Precedence
If any conflict arises between these Terms and a signed agreement between you and CWC — including an Artist Donation Agreement, Youth Artist Donation Agreement, or Partner Nonprofit Campaign Agreement — the signed agreement governs with respect to its subject matter.
If any conflict arises between these Terms and our Return & Refund Policy regarding returns, refunds, or cancellations, the Return & Refund Policy governs.
Privacy
Your use of our website is also governed by our Privacy Policy, which describes how we collect, use, and protect your information. Please review it before using our services.
Severability
If any provision of these Terms is found to be invalid or unenforceable, that provision shall be limited or removed to the minimum extent necessary, and all remaining provisions shall remain in full force and effect.
Entire Agreement
These Terms, together with our Return & Refund Policy and Privacy Policy, constitute the entire agreement between you and CWC regarding your use of our website and services, except where a separately signed agreement applies as described under Order of Precedence.
Governing Law
These Terms are governed by the laws of the State of Texas, without regard to conflict of law principles. Any disputes shall be resolved in Williamson County, Texas.
Changes to These Terms
We may update these Terms periodically. Material changes will be reflected in the “Last Updated” date below. Continued use of our website following any update constitutes acceptance of the revised Terms.
